All rates are quoted nett in Malaysian Ringgit (RM) and are 10% commissionable. All ad hoc fuel supplements are non-commissionable.

Touchdown reserves the right to revise the contract rates at any time, giving no less than 60 days written notice. Such revision will have no effect on guaranteed reservations made prior to the notice of revision.

Rates may increase without prior notice due to any changes or imposition of government charges, taxes or levies.

The Sunseeker 46 and 55 and the Gulfcraft 53 are internationally registered and insured for a maximum of 12 passengers (not including crew) per vessel.

The Bladerunner 34 is Malaysian registered and insured for a maximum of 4 passengers (not including captain.)

The Halvorson 80 “Jade Princess” is internationally registered and insured for a maximum of 56 passengers (not including crew).

All charter times, anchorages and itineraries are approximate due to weather, wind and safety considerations while en-route. Routes may be modified at the captain’s discretion if conditions warrant.

All yachts will depart from Sutera Harbour Marina.

Note: No transfers are included in the tours and passengers need to arrange any required land transfers.

Cruising outside of the National Park Waters will be subject to additional fuel supplements.

For Pulau Tiga and Pulau Mantanani day charters, the contract rates stipulate an inclusive fuel supplement.

For Pulau Mengalum, overnight cruising and other ad hoc cruising destinations, the fuel supplement will be quoted on an ad hoc basis. Ie :

     1) Pulau Mengalum/Pulau Tiga at an additional RM999.00 nett per trip (not per person).

     2) Pulau Mantanani at an additional RM1299.00 nett per trip (not per person).

All ad hoc fuel supplements are non-commissionable.

1. Client Cancellation

Sunset Cruise/Day Cruise:

Prior to 48 hours – 100 % of charter fee is refundable to client.

48 - 12 hour cancellation – 50 % of charter fee is chargeable to client.

Within 12 hour cancellation – 100% of charter fee is chargeable to client.

2. A verse Weather Conditions

Full refund to client and/or option to reserve an alternative date/time if vessel(s) available. No compensation will be afforded.

Full refund to client and/or option to reserve an alternative date/time if vessel is available. No compensation will be afforded. Touchdown Holidays will make all effort to ensure that vessels are made available according to schedule.

A credit term period may be established with Touchdown Holidays through official application; the approval of which will be entirely at the discretion of Touchdown Holidays. The company reserves the right to reject or withdraw such credit as it deems necessary in the event of payment default through failure to settle payment within 30 days from the date of billing and/or the credit limit is extended. Alternatively, immediate credit may be granted through a floating deposit of Banker’s Guarantee (to be renewed annually).

Ad-Hoc bookings will be subject to 100% pre-payment.

Children under 8 years of age are not permissible without prior approval of the Captain. Note that Touchdown Holidays will accept children under this age subject to Captain’s approval.

Children’s rate for yacht is RM50.00 per child under the age of 12. Children under the age of 4 are complimentary.

Parents/Guardians must take full responsibility over minors and children are taken onboard at Parent/Guardian’s own risk. A disclaimer waiver will be signed prior to each cruise.

To ensure the safety of the passengers, crew and vessel at all times, the Captain’s opinions and decisions will be considered final and irrefutable.

No service charge has been applied to the charter price. Tips/gratuities are at passengers’ discretion.

Touchdown Holidays reserves the right to terminate at anytime giving notice in writing to cancel this agreement should the agent fail to fulfil the said terms and conditions.

It is expressly agreed and declared that the proper law of the Agreement is the law of Malaysia and that any disputes, actions or other matters arising hereunder shall be determined in a court of Law in Malaysia in accordance with the law and procedures of Malaysia and under any and all circumstances.

Touchdown Holidays reserves the right to cancel any yachts due to weather conditions or any other reason, or to substitute vessels. Although all care is taken, Touchdown will not accept responsibility for damages resulting from the failure to depart/arrive on time, nor for errors herein.

By signing on this agreement, Touchdown Holidays shall not be held liable or responsible for failure to execute arrangements specified herein directly or indirectly occasioned by or through or in consequence of war, strikes, riots, inclement weather and Acts of God or conditions beyond the control of Touchdown Holidays.

The operator confirms and agrees that this Agreement is strictly confidential between Touchdown Holidays and your company, and your company shall not in any circumstances divulge or permit to be divulged the contents of this Agreement.
